Each carries distinct obligations, exemptions, and procedural requirements that change frequently. Incorrect assumptions about any one of them can trigger tax notices, frozen bank accounts, blocked property transactions, or TDS at the punitive rate of 20%.

PAN Card for NRIs -- Why It Is Mandatory {#pan-card-for-nris}

The Permanent Account Number is not optional for any NRI who earns income in India. Section 139A of the Income Tax Act, 1961 requires PAN for every person whose total income exceeds the basic exemption limit, or who enters into specified financial transactions in India.

Situations where PAN is mandatory for NRIs:

  • Rental income from property in India
  • Capital gains on sale of Indian property, shares, or mutual funds
  • Interest income from NRO/NRE fixed deposits (NRO interest is taxable; NRE interest is exempt but PAN still helps avoid higher TDS)
  • Dividend income from Indian companies
  • Income from business or profession carried out in India
  • Purchase or sale of immovable property valued above Rs 10 lakh
  • Opening an NRO or NRE bank account
  • Investment in mutual funds, shares, or debentures
  • Filing income tax returns in India
  • Claiming TDS refunds

Without PAN, TDS is deducted at the higher rate of 20% under Section 206AA instead of the applicable treaty rate or the rate specified in the Act. For example, TDS on property sale for an NRI is normally 12.5% on long-term capital gains. Without PAN, this jumps to 20% -- a significant and avoidable cash-flow hit.

Action Point: If you are an NRI with any Indian income source -- however small -- obtain a PAN immediately. The cost and effort are minimal compared to the financial consequences of operating without one.


PAN 2.0 -- The QR Code Upgrade {#pan-20-qr-code-upgrade}

The Government of India approved the PAN 2.0 project to modernize the PAN ecosystem. Under PAN 2.0, every PAN card now carries a dynamic QR code that stores the cardholder's latest demographic details -- name, date of birth, photograph, and PAN number.

What NRIs need to know about PAN 2.0:

  • No new PAN number is issued. Your existing 10-digit alphanumeric PAN remains the same. PAN 2.0 is an infrastructure upgrade, not a re-issuance.
  • Existing PAN cards remain valid. You are not required to apply for a new physical card. However, you can request an updated card with the QR code if needed.
  • Free e-PAN with QR code. NRIs can download their updated e-PAN (digital PAN with QR code) from the Income Tax e-filing portal at no cost. This digital version is legally valid for all purposes.
  • Enhanced verification. The QR code allows instant verification of PAN details by banks, registrars, and other entities. This reduces fraud and speeds up KYC processes for NRIs transacting remotely.
  • Unified portal. PAN 2.0 consolidates PAN-related services -- allotment, updates, corrections, Aadhaar linking -- into a single unified portal, simplifying the process for NRIs who previously had to navigate between NSDL and UTIITSL portals.
  • Common Business Identifier. PAN is being positioned as the common business identifier across government systems, making it even more critical for NRIs with business interests in India.

How to get your PAN 2.0 e-PAN:

  1. Visit the Income Tax e-filing portal (incometax.gov.in)
  2. Log in with your PAN and password
  3. Navigate to the e-PAN download section

How NRIs Apply for PAN Online {#how-nris-apply-for-pan-online}

NRIs can apply for PAN entirely online without visiting India. There are two routes depending on whether you hold an Indian passport.

Route 1: Form 49A (Indian Citizens, including NRIs holding Indian Passport)

  • Apply through the NSDL/Protean or UTIITSL portal

Aadhaar is not mandatory for NRIs. The Aadhaar Act, 2016, and its subsequent amendments make Aadhaar enrolment voluntary for NRIs. No government authority, bank, or financial institution can deny services to an NRI solely on the ground that they do not possess Aadhaar.

However, having Aadhaar provides practical advantages.

Benefits of Aadhaar for NRIs:

  • Simplified KYC: Aadhaar-based e-KYC makes it faster to open and operate bank accounts, demat accounts, and mutual fund folios remotely
  • ITR filing convenience: While not mandatory for NRIs, having Aadhaar simplifies the e-verification process for tax returns
  • Property registration: Some state registrar offices accept Aadhaar as primary ID, making registration smoother when an NRI visits India
  • Government services during visits: Aadhaar enables access to various government services, subsidies, and digital platforms during India trips
  • SIM card procurement: Getting a mobile SIM card in India is significantly easier with Aadhaar-based e-KYC
  • DigiLocker access: Aadhaar enables DigiLocker, where NRIs can store and access official documents digitally from anywhere in the world

Important limitation: NRIs who obtained Aadhaar while they were residents of India should be aware that Aadhaar may become inactive if biometric updates are not done periodically. UIDAI recommends updating biometrics at least once every 10 years.


Aadhaar Enrolment Process During India Visit {#aadhaar-enrolment-process}

NRIs who hold a valid Indian passport can enrol for Aadhaar during a visit to India. The process requires physical presence at an Aadhaar enrolment centre.

Step-by-step process:

  1. Check eligibility. You must hold a valid Indian passport. OCI holders and foreign nationals are not eligible for Aadhaar.

  2. Locate an enrolment centre. Use the UIDAI website (uidai.gov.in) or mAadhaar app to find the nearest Aadhaar Seva Kendra or enrolment centre.

  3. Book an appointment. Walk-ins are accepted at many centres, but booking an appointment online saves time. Appointments can be booked through the UIDAI portal.

  4. Carry required documents:

    • Indian passport (valid, unexpired)
    • Proof of address in India (if available) or a letter from a relative with whose address you wish to register, along with their Aadhaar
    • If you do not have an Indian address, some centres accept the Indian passport address page as both identity and address proof
  5. Biometric capture. Your fingerprints, iris scan, and photograph will be captured at the centre. This is a one-time process.

  6. Receive acknowledgment slip. You will receive an enrolment number. Aadhaar is typically generated within 15-30 days.

  7. Download e-Aadhaar. Once generated, download e-Aadhaar from the UIDAI website. The physical Aadhaar letter is mailed to the address provided during enrolment.

Timing tip: Schedule your Aadhaar enrolment at the beginning of your India visit. The process takes only 15-20 minutes at the centre, but you want enough days for the Aadhaar to be generated before you leave, in case any bank or institution requires it during your trip.


PAN-Aadhaar Linking -- NRI Exemption Explained {#pan-aadhaar-linking}

This is one of the most misunderstood areas for NRIs. Here is the definitive position.

NRIs are exempt from mandatory PAN-Aadhaar linking.

Section 139AA of the Income Tax Act mandates PAN-Aadhaar linking for "every person who has been allotted PAN and who is eligible to obtain Aadhaar." Since Aadhaar enrolment is voluntary for NRIs (not mandatory), NRIs are not "eligible to obtain Aadhaar" in the mandatory sense. Therefore, the linking requirement does not apply to them.

CBDT Circular No. 7/2022 and subsequent clarifications confirm that individuals who are not residents of India as per the Aadhaar Act are not required to link PAN with Aadhaar.

What This Means in Practice

  • Your PAN will not become inoperative merely because you have not linked it with Aadhaar, provided you are a Non-Resident
  • If you have Aadhaar (obtained when you were a resident), you may still link it voluntarily -- but there is no penalty for not doing so as long as you are an NRI
  • If your PAN has been incorrectly marked as inoperative due to non-linking, you can file a grievance on the Income Tax portal citing your NRI status to get it reactivated

The Critical Nuance

If you return to India and become a Resident again, the linking requirement kicks in. At that point, you must link PAN with Aadhaar within the timelines prescribed by CBDT, or your PAN risks becoming inoperative.


PAN Inoperative Consequences for NRIs {#pan-inoperative-consequences}

Even though NRIs are exempt from PAN-Aadhaar linking, it is important to understand what happens when a PAN becomes inoperative -- because some NRIs face this issue due to administrative errors or status mismatches.

When PAN becomes inoperative, the following consequences apply:

  1. Higher TDS at 20%. Tax deducted at source on all Indian income jumps to 20% (or the rate in force, whichever is higher) under Section 206AA
  2. Cannot file ITR. Income tax return filing is blocked with an inoperative PAN
  3. No TDS refund processing. Pending refunds are not processed until PAN is reactivated
  4. Financial transactions blocked. Banks, mutual fund houses, and depository participants may restrict transactions
  5. Property transactions affected. Registrars may refuse to register property sale or purchase deeds
  6. Higher TCS. Tax Collected at Source on applicable transactions is levied at a higher rate

How NRIs can reactivate an incorrectly inoperative PAN:

  • Log in to the Income Tax e-filing portal
  • Navigate to the PAN-Aadhaar linking section
  • If the system shows your PAN as inoperative, file a grievance under "PAN-related issues"
  • Clearly state your NRI status and provide supporting evidence (passport with entry/exit stamps, visa, foreign tax residency certificate)
  • The Income Tax Department typically resolves these grievances within 30 days

Do not ignore a PAN inoperative notice. Even if you believe you are exempt, take proactive steps to resolve it. The financial impact of operating with an inoperative PAN is severe.


OCI Card -- Rights, Restrictions, and Rules {#oci-card-rules}

The Overseas Citizen of India (OCI) card is a lifelong visa and quasi-citizenship document for persons of Indian origin who have acquired foreign citizenship. As of 2026, OCI has fully replaced the earlier PIO (Person of Indian Origin) card scheme.

What OCI Cardholders CAN Do in India

  • Enter India without a visa -- multiple entry, multipurpose, lifelong visa
  • Stay in India indefinitely -- no registration required with FRRO/FRO for stays up to 180 days; registration required for stays exceeding 180 days in a calendar year
  • Own residential and commercial property -- OCI holders can purchase, own, and sell residential and commercial real estate in India, subject to FEMA regulations
  • Open NRO and NRE bank accounts -- full banking access similar to NRIs holding Indian passport
  • Invest in Indian markets -- stocks, mutual funds, bonds, debentures, and other securities through the FPI or NRI route
  • Work in India -- no separate work permit required for private sector employment; some professions may require additional registration
  • Start and run businesses -- OCI holders can start businesses, become directors in companies, and operate in India commercially
  • Access education -- admission to educational institutions under the general/NRI category (not domestic quota in most cases)
  • Practice professions -- doctors, lawyers, architects, and chartered accountants with appropriate Indian qualifications and registrations can practice

What OCI Cardholders CANNOT Do

  • Vote in Indian elections -- OCI holders have no voting rights at any level (Panchayat, State, or Central)
  • Hold constitutional offices -- cannot become President, Vice President, Supreme Court or High Court Judge, Member of Parliament, or Member of State Legislature
  • Purchase agricultural land, farmhouse, or plantation property -- this is a hard restriction under FEMA. OCI holders cannot buy agricultural land or farmhouses under any circumstances. However, they can inherit agricultural land
  • Travel to restricted/protected areas without permission -- certain areas in India require a Protected Area Permit (PAP) or Restricted Area Permit (RAP)
  • Obtain an Indian passport -- OCI is not dual citizenship; the holder remains a citizen of their foreign country
  • Government employment -- OCI holders cannot take up government or public sector jobs in India (with limited exceptions in research and academic institutions)

OCI Card and Property -- The Agricultural Land Exception

The restriction on agricultural land is absolute for purchase. However, OCI holders can:

  • Inherit agricultural land, plantation property, or farmhouse from a relative
  • Hold agricultural land already inherited (they are not required to sell it)
  • Earn income from such inherited agricultural land

They cannot, however, purchase additional agricultural land or enter into a sale agreement to acquire it.

OCI Card Renewal and Re-issuance

  • OCI cards issued before December 2016 must be re-issued if the holder obtains a new passport (due to renewal, name change, or change in nationality)
  • OCI cards issued after December 2016 need re-issuance only twice: once when a new passport is issued before the holder turns 20, and once when a new passport is issued after the holder turns 50
  • Re-issuance is done through the Indian Mission/Post in your country of residence or through the OCI portal

Digital KYC for NRIs {#digital-kyc-for-nris}

Digital KYC has simplified remote account management for NRIs, but the process differs significantly from the resident KYC framework.

Video KYC (V-KYC)

Most major banks and financial institutions now offer Video KYC for NRIs.

  • Process: A video call with a bank representative where you show your original documents (passport, OCI card, visa, foreign address proof)
  • Timing: Typically scheduled during Indian business hours; some banks offer extended hours for NRIs in Western time zones
  • Documents to keep ready: Passport, PAN card, visa/OCI card, overseas address proof (utility bill or bank statement), photograph, signature

CKYC (Central KYC)

  • Once you complete KYC with one financial institution, your KYC record is uploaded to the Central KYC Registry (managed by CERSAI)
  • Your CKYC Identifier (a 14-digit number) can be used across all financial institutions, reducing paperwork
  • NRIs should ask their bank for their CKYC number after completing KYC for the first time

Aadhaar-Based e-KYC for NRIs

KYC Update Requirements

  • NRIs must update KYC whenever they change their residential status (Resident to NRI or NRI to Resident)
  • Address changes, passport renewal, and name changes all require KYC updates
  • Failure to update KYC can result in account freezing, especially for NRO accounts where the bank has compliance obligations under FEMA

Power of Attorney -- GPA vs SPA {#power-of-attorney-gpa-vs-spa}

NRIs who cannot be physically present in India for property transactions, legal proceedings, or financial management typically execute a Power of Attorney (PoA). Understanding the distinction between General Power of Attorney (GPA) and Special Power of Attorney (SPA) is critical.

General Power of Attorney (GPA)

  • Grants broad authority to the agent to act on behalf of the NRI across a wide range of matters
  • Covers property management, bank operations, legal representation, tax filings, and more
  • Continues in effect until revoked by the principal or until the principal's death
  • Risk factor: Because of its broad scope, GPA creates higher risk of misuse. Courts have also held that property sales executed solely through GPA (without a registered sale deed) are not valid conveyances

Special Power of Attorney (SPA)

  • Grants limited, specific authority for a defined purpose
  • Examples: SPA to sell a specific property, SPA to operate a specific bank account, SPA to represent in a specific legal case
  • Automatically expires once the specific act is completed
  • Recommended for NRIs in most situations because it limits exposure and provides clearer legal protection

How NRIs Execute a Power of Attorney from Abroad

  1. Draft the PoA with the help of a qualified lawyer. Specify the exact powers being granted, the property details (if applicable), and any limitations
  2. Get it notarized by a Notary Public in your country of residence
  3. Get it attested/apostilled:
    • For countries that are part of the Hague Apostille Convention: get an Apostille stamp from the designated authority
    • For non-Hague countries: get it attested by the Indian Embassy or Consulate
  4. Send the original to India for registration (if required) and use
  5. Adjudication and stamping: Once in India, the PoA must be adjudicated (stamped) within three months of execution as per the Indian Stamp Act. Stamp duty varies by state.

The Supreme Court of India in Suraj Lamp & Industries Pvt. Ltd. v. State of Haryana (2012) held that immovable property can only be legally transferred through a registered sale deed or gift deed. Property transfers through GPA alone are not recognized as valid sales. NRIs should be cautious of any "GPA sale" arrangement -- the correct procedure is to execute a registered sale deed, with the PoA holder acting as the authorized signatory.


Passport Renewal Impact on NRI Status {#passport-renewal-impact}

A common concern among NRIs is whether renewing their Indian passport affects their NRI/residential status for tax purposes. The short answer: it does not.

Key clarifications:

  • Tax residency is determined solely by physical presence in India under Section 6 of the Income Tax Act. Passport issuance, renewal, or cancellation has no bearing on this determination.
  • Renewing your passport at an Indian Embassy/Consulate does not create any presumption of resident or non-resident status.
  • Surrendering your Indian passport upon acquiring foreign citizenship does not automatically change your FEMA or tax status for the year in which the surrender happens. Your status for that financial year is still determined by your days of presence in India.
  • OCI holders who have surrendered their Indian passport are treated as foreign nationals for FEMA purposes but may still be Resident in India for tax purposes if they meet the day-count criteria.

  • Update your new passport number with all Indian banks, demat accounts, mutual fund folios, and the Income Tax portal
  • If your name has changed (due to marriage or other reasons), update it across all financial records simultaneously to avoid mismatches

Document Attestation from Abroad {#document-attestation-from-abroad}

Apostille (Hague Convention Countries)

If your country of residence is a member of the Hague Apostille Convention (which includes the USA, UK, Canada, Australia, most EU countries, UAE, and many others):

  • Documents issued in that country can be apostilled by the designated competent authority (e.g., Secretary of State in the US, Foreign and Commonwealth Office in the UK)
  • An apostilled document is accepted in India without further attestation by the Indian Embassy
  • India itself is a member of the Hague Convention, so Indian documents can also be apostilled for use abroad

Embassy Attestation (Non-Hague Countries)

For countries that are not part of the Hague Convention:

  • Documents must be attested by the Indian Embassy or Consulate in that country
  • The process typically involves notarization by a local notary, followed by attestation by the Ministry of External Affairs equivalent, followed by Indian Embassy attestation

  • Always keep certified copies. Sending original documents to India carries risk of loss in transit.

  • Some Indian states now accept electronically signed and transmitted PoAs for specific purposes -- check with your local sub-registrar.

Common Mistakes NRIs Make with Documents {#common-mistakes}

Based on our practice advising hundreds of NRIs annually, these are the most frequently seen documentation errors.

1. Not updating residential status with banks. Many NRIs continue operating resident savings accounts instead of converting to NRO/NRE. This is a FEMA violation that carries penalties up to three times the amount involved.

2. Having two PANs. Some NRIs apply for a new PAN abroad without realizing they already have one from their resident days. Holding two PANs is illegal (Section 272B penalty of Rs 10,000) and creates tax filing chaos.

3. Assuming Aadhaar is mandatory for everything. NRIs panic when a bank demands Aadhaar. Under RBI Master Directions, banks must accept alternative KYC documents (passport, OCI card, overseas address proof) from NRIs. Escalate if frontline staff insist otherwise.

4. Using an expired OCI card for property transactions. OCI cards issued before 2016 with old passports are often treated as invalid by property registrars. Get your OCI re-issued against your current passport before initiating any property transaction.

5. Executing GPA for property "sale" instead of a registered sale deed. As discussed above, GPA-based property transfers are not legally valid. The buyer and NRI seller both bear risk if this route is used.

6. Not getting PoA adjudicated within three months. A Power of Attorney executed abroad must be stamped (adjudicated) in India within three months of execution. Missing this deadline means paying penalty stamp duty, which varies by state and can be substantial.

7. Ignoring PAN-AIS/TIS data. The Annual Information Statement (AIS) and Taxpayer Information Summary (TIS) on the Income Tax portal now capture all financial transactions linked to your PAN. NRIs who do not check these regularly miss discrepancies that later trigger scrutiny notices.

8. Not updating passport number after renewal. Banks, demat accounts, and the Income Tax portal all store your passport number. After renewal, a mismatch can freeze transactions or trigger compliance alerts.
